GPSR regulations: what they are and how they affect your small business

A walkthrough of the EU General Product Safety Regulation, which came into effect on Friday 13 December 2024, and what it means for a small business selling into Europe. We cover the authorised representative requirement, the prices we were given (199 euros for one product type through EAS Project, 498 euros for three), and why we went with plastic products only, turning off glossy photo paper and notebooks in the European market. Also covers safety labels, technical files, marketplace enforcement on Etsy and Amazon, and why selling to Northern Ireland now needs GPSR compliance.

GPSR, General Product Safety Regulations. What is it and how is it going to affect your small business? On Friday the 13th of December, the new GPSR regulations for Europe will come into effect. But what is GPSR? The objectives of GPSR are to ensure the safety of all products including those linked to new technologies, address the challenges posed by the growth of online sales and in particular via online marketplaces, show a better enforcement of the rules and more efficient and even market surveillance, and to improve the effectiveness of recalls of dangerous products in the hands of consumers. But what does all this mean? We're talking labels, technical files, risk assessments, if you're based outside the EU, a authorised representative. Now please bear with me as I try and be as detailed as possible with the information that's given, which is extremely vague. Authorised representative is a person that is inside of the EU and will represent your company in the basis of a check or a safety challenge. They will be the ones who liaise with the authorities, all of your technical files and safety information. Looking at all of these duties by the AR, you must already be thinking how much is this going to cost me. And I have heard too much scaremongering in terms of prices and product categorization. All I can tell you is how much we were charged and what product types we were categorized under. We chose to go with EAS Project, who charged us €199 for one product type. But what does that mean? All of your items can be classed under a safety product type. In my case, this was plastic products, paper products and magnetic products. The price for three product types would have been 498 euros, which is a little bit too much for our business. And so I decided to go with one product type being represented in Europe, which was plastic products. But what does this mean for paper and magnetic products? Under the subcategory of paper, the only products that we actually sell which are holy paper are our glossy photo paper and notebooks in the shop section. And so these products have been turned off in the European market. What about magnets? Well, this is where it gets a little bit complicated, and it all comes down to who is deemed the manufacturer. There are several roles in the line of sale, including online marketplaces, resellers, suppliers, and manufacturers. As you may or may not be aware, China has had to adhere to a lot of these regulations for the last 21 years. This means that a lot of products already have their own EU representative, they have safety information, and other batch numbers on the actual packaging themselves. However, coming back to the role of manufacturer, If you were to take these items out of their original packaging and repackage them, you are then becoming the manufacturer. By rebranding, relabeling or any of the above, you then become the manufacturer and your information must be on the product packages. This also means that you must also appoint your own AR. So moving back to Stickiply and how it applies to our small business, if we keep our magnets in their original packaging from our manufacturer, we can resell them to Europe as a supplier using the existing label and existing EU rep. You're going to need to do for yourself is assess whether the sales that you're making in Europe justify the price of over 200 euros per year to sell to the European market. And so we move on to the first noticeable change of your products, which is the labeling of safety information. Every product that enters the European Union will need its own safety label. This label must include the product name, the product identifier, the batch number, the manufacturer, your EU representative, storage instructions, warning and safety information in up to 24 recognised languages within the EU, any safety labels and icons, and a statement of compliance. Along with the safety labels, you'll need to give your AR a technical file for each of your products, which includes the product information and identification, your technical specifications, user instructions and warnings, disposal, risk assessments, potential risks and mitigation that you've done for the risks, a safety monitoring plan, testing and compliance certificates, declaration of conformity and any documentation, records, maintenance and updates for the product. If your products do get stopped at the border, these are the files that your AR will be required to give to the authorities to ensure your compliance with GPSR. Now let's move on to online marketplaces. Online marketplaces like Etsy, Amazon, eBay and more will also be under the stipulation of GPSR. Etsy and Amazon have been very clear in the fact that they will just take your listing down and possibly ban your account if your account does not meet GPSR regulations. The next part of this fuckery is Northern Ireland. Northern Ireland, although is in the UK, is part of the European Customs Union, which means that you will need GPSR compliance to sell to Northern Ireland. And I know people are thinking now, well, how do I split my post? Like, UK is UK, right? No. In fact, online marketplaces have already started to segregate Northern Ireland from the UK in terms of postal region. Europe will now become EU and Northern Ireland. And the UK will now exclude Northern Ireland. No, you're bored, right? Me too, yeah. Next part is digital products. The information that we received from the Department of Business and Trade on digital products sold online to the EU. They explained that digital products will only be included in GPSR if they expose customers to cyber security risks. Talking about software, not your little SVGs on Etsy. However, this is still open for interpretation, so... They also explored the use of QR codes on product safety labels. The moment we are still in need of clarification on whether they can be used to display safety information. Through our safety labels, this QR code only links to the actual product on the website where we can display more information about how to use our products.
